Privacy policy

1. ABOUT THIS POLICY

Hudson Valley Seed Company (“we,” “us,” or “our”) operates hudsonvalleyseed.com and the related shopping services, customer support, and marketing communications described in this policy (the “Services”). Our online store is powered by Shopify.

This Privacy Policy explains how we collect, use, disclose, and retain personal information and how you can exercise your privacy choices. It applies when you visit our website, make or attempt a purchase, use our Services, or communicate with us.

“Personal information” means information that identifies you or can reasonably be linked to you. It does not include information that has been properly de-identified under applicable law.

Using our Services does not, by itself, constitute consent to every use of personal information or to optional marketing communications. Where consent is required, we obtain it separately. If our Terms of Service conflict with this policy concerning the collection, processing, or disclosure of personal information, this policy controls on those subjects.

2. PERSONAL INFORMATION WE COLLECT

The information we collect or process depends on how you interact with us and the Services you use. Categories may include:

  • Contact and identifying information: your name, email address, telephone number, billing address, shipping address, customer or online identifiers, and similar contact information.
  • Account information: account identifiers, login-related information, preferences, and settings associated with your customer account, where applicable.
  • Purchase and transaction information: products you view, add to a cart or wishlist, purchase, return, or exchange; order history; payment status; and fulfillment information.
  • Payment information: payment method, transaction details, payment confirmations, and payment information processed by our payment providers. The information available to us depends on the payment method and provider.
  • Communications and content: information you provide when contacting customer support, submitting a review, responding to a message, or otherwise communicating with us.
  • Device and internet activity: IP address, browser and device information, identifiers, referring pages, and information about how and when you interact with our website and communications.
  • Approximate location: location inferred from information such as your IP address.
  • Marketing preferences and inferences: subscription preferences, consent records, engagement with communications, and interests inferred from shopping or browsing activity.

We collect personal information directly from you; automatically through cookies and similar technologies; from service providers that help us operate the Services; and from business or marketing partners where permitted by law.

3. HOW WE USE PERSONAL INFORMATION

We use personal information for the following purposes, as applicable:

  • Operating our store and fulfilling transactions, including processing payments, arranging shipping, providing order updates, managing returns, and providing customer support.
  • Maintaining accounts and preferences, remembering cart contents, supporting wishlists and reviews, and personalizing the shopping experience.
  • Improving the Services, understanding how visitors use our website, and measuring the performance of our store and marketing.
  • Sending marketing communications and providing advertising, subject to applicable law and your choices.
  • Protecting our customers and business, including detecting fraud, securing accounts and transactions, and investigating unlawful activity.
  • Complying with legal obligations, maintaining necessary business records, resolving disputes, and enforcing our agreements.

4. COOKIES, TRACKING, AND YOUR CHOICES

We and our service providers and partners, including Shopify, use cookies, pixels, and similar technologies. These technologies may support essential store functions, preferences, analytics, and advertising.

Essential technologies help provide functions such as shopping carts, checkout, security, and the storage of privacy preferences. Other technologies may help us understand website use, personalize content, measure advertising, or show advertising based on activity across websites and services.

Where required by applicable law, we obtain consent before using non-essential technologies. You can use the cookie controls presented on our website to make or change the choices available to you. You can also adjust browser settings to block or delete cookies, although some store functions may not work correctly.

Browser cookie settings and advertising-platform preference tools are additional controls; they do not replace our store's own sale/sharing and targeted-advertising opt-out mechanism.

For sale/sharing and targeted-advertising choices, use:

Your Privacy Choices

5. EMAIL AND SMS COMMUNICATIONS

We may send promotional emails and, if you enroll in our text-message program, promotional text messages, subject to applicable law and your choices. Providing a telephone number for an order does not by itself enroll you in promotional SMS messages. Consent to promotional text messages is not a condition of purchase.

You can unsubscribe from promotional emails using the link in the message. You can opt out of our text-message program by replying STOP or following the instructions provided in the message. After an SMS opt-out, we may send a one-time confirmation, but will not continue messages from that program unless you subsequently opt in again. Opting out of marketing does not prevent necessary order or customer-service communications through other permitted channels.

Our website uses cookies and similar technologies to remember cart activity, including abandoned carts. For customers enrolled in the applicable messaging program, this information may be used to determine when to send cart-reminder messages, subject to applicable consent requirements and privacy choices.

We use service providers to operate our messaging programs. Relevant information, including telephone numbers, message activity, and consent records, may be processed by those providers to deliver messages, manage subscriptions, honor opt-outs, and support compliance.

Mobile opt-in data and consent information are not sold or shared with third parties or affiliates for their own independent marketing or promotional purposes. We may disclose this information to service providers that help us operate our messaging program, subject to appropriate restrictions.

Additional text-message program terms are available in our Terms of Service.

6. HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information, as appropriate to the purpose, to:

  • Shopify and providers supporting our store, including providers involved in hosting, payments, shipping, fulfillment, customer support, analytics, reviews, wishlists, communications, and related services.
  • Advertising and marketing partners to provide, measure, and improve advertising or marketing, subject to applicable law and your choices.
  • Recipients you direct us to share information with, or where you otherwise authorize disclosure.
  • Authorities, professional advisers, and other recipients where reasonably necessary to comply with law, respond to valid legal process, protect rights or safety, or investigate fraud.
  • Parties involved in a proposed or completed business transaction, such as a merger, acquisition, reorganization, or sale of business assets, subject to applicable safeguards.

Information posted publicly, such as a published product review, may be visible to other people. Third-party websites and services have their own privacy practices, which you should review when using them.

7. SALE, SHARING, AND TARGETED ADVERTISING

Certain disclosures to advertising partners may constitute a “sale” of personal information, “sharing” for cross-context behavioral advertising, or processing for “targeted advertising” under applicable US state laws. These terms can apply even when no money is exchanged for the information.

Depending on the advertising services used, relevant information may include contact or online identifiers, device information, browsing and usage activity, purchase activity, and related inferences. The recipients may include advertising platforms and marketing partners, including Shopify when its applicable enhanced advertising services are used.

You can exercise applicable opt-out rights here.

You do not need to create an account to submit a sale/sharing or targeted-advertising opt-out. We do not require identity verification for these opt-outs, but may request information reasonably necessary to apply the choice to the correct person or data.

An advertising opt-out does not stop processing needed to fulfill orders, provide requested services, prevent fraud, or meet legal obligations. It also does not automatically unsubscribe you from email or SMS programs, which have separate controls.

Where applicable law requires us to recognize Global Privacy Control (GPC), we treat that signal as an opt-out request for the browser and device sending it. Where we can associate the signal with your account, we also apply the opt-out to that account as required by applicable law.

Learn more about Global Privacy Control.

We do not recognize other legacy “Do Not Track” signals as privacy requests. This does not change our treatment of recognized GPC signals.

8. OUR RELATIONSHIP WITH SHOPIFY

Shopify hosts our store and collects and processes personal information about your access to and use of the Services to provide and improve them. Information submitted through the Services may be transmitted to Shopify and other providers in countries outside the country where you live.

We use certain Shopify enhanced features that incorporate information about your interactions with our store, other merchants, and Shopify to help protect, grow, and improve our business. For example, applicable enhanced services may support personalized advertising using activity across merchants and websites.

For the processing Shopify undertakes for these purposes, Shopify is responsible for responding to requests concerning that processing, as described in its privacy policy.

You may contact us about information we control using the contact details below. Shopify's portal is an additional route for requests concerning Shopify's own processing, not a replacement for submitting requests to us.

9. SENSITIVE PERSONAL INFORMATION

Certain information may be considered “sensitive personal information” under applicable privacy laws.

We do not use sensitive personal information for purposes other than those permitted by applicable law. Where applicable law provides a right to limit the use or disclosure of sensitive personal information, you may exercise that right using the contact information provided in this Privacy Policy.

10. RETENTION AND SECURITY

We retain personal information for as long as reasonably necessary for the purposes described in this policy, subject to applicable legal requirements.

Relevant criteria include whether information is needed to fulfill a transaction, maintain an account or communication preference, respond to customer inquiries, maintain tax and accounting records, prevent fraud, resolve disputes, or comply with legal obligations.

Retention needs differ by category. For example, transaction records may need to be retained for legal or accounting purposes after an account is closed, while marketing and tracking information should be retained only as needed for the applicable purpose.

We may retain limited suppression or opt-out records to avoid contacting you again or overriding your privacy choices.

Deletion requests are subject to applicable exceptions. We do not promise to erase records that we are legally required or otherwise permitted to retain.

We use safeguards designed to protect personal information. No security measure or transmission method is completely secure. Please avoid sending payment credentials or other sensitive information through ordinary email.

11. YOUR PRIVACY RIGHTS

Depending on where you live and which laws apply, you may have rights to:

  • Access or know what personal information we maintain about you and how it is used or disclosed.
  • Obtain a portable copy of certain personal information.
  • Correct inaccurate personal information.
  • Request deletion, subject to legal exceptions.
  • Opt out of sale, sharing, or targeted advertising.
  • Limit certain uses or disclosures of sensitive personal information, or withhold or withdraw consent to certain processing, where applicable.
  • Opt out of certain profiling that produces legal or similarly significant effects, if we engage in that processing and the applicable law provides that right.
  • Appeal a decision about your privacy request where applicable.
  • Exercise your rights without unlawful discrimination.

To submit a request, email mail@hudsonvalleyseed.com or call +1 845-204-8769.

For sale/sharing and targeted-advertising opt-outs, you may also use the opt-out page linked above.

Please tell us which right you want to exercise and provide sufficient information for us to locate the relevant records. Do not send sensitive identity documents unless we request them through an appropriate channel.

For requests that require verification, we use reasonable procedures permitted by law to confirm your identity and authority. We use information submitted for verification to handle the request and for related permitted compliance purposes. An account is not required to make a privacy request.

You may authorize an agent to submit requests on your behalf. Where permitted by law, we may request evidence of authorization and may ask you to verify your identity or confirm the authorization directly. Different requirements apply to opt-out requests.

We respond within the period required by applicable law. If a permitted extension is needed, we provide the required notice. If we deny a request, we explain the basis as required by law.

12. APPEALS

If we deny a privacy request where applicable law provides a right to appeal, you may appeal our decision by contacting mail@hudsonvalleyseed.com and stating that you are appealing a privacy-request decision.

We will review and respond within the applicable legal timeframe and provide information about further complaint options where required.

13. FINANCIAL INCENTIVES

We may offer discounts or other benefits in connection with participation in certain marketing programs.

Participation is voluntary. The personal information involved may include your email address and marketing preferences.

You may withdraw from the marketing program at any time by unsubscribing from our marketing communications. Withdrawing from marketing communications does not affect your ability to make purchases from us.

The terms of any discount or other benefit are presented to consumers when they participate in the applicable program.

14. ADDITIONAL INFORMATION FOR THE EEA AND UK

Where applicable European or UK data protection law applies, the legal basis for processing depends on the purpose. It may include performing a contract with you, complying with legal obligations, pursuing legitimate interests where appropriate and balanced against your rights, or relying on consent where required.

You may also have rights to object to processing, request restriction of processing, and withdraw consent where processing relies on consent. Withdrawal does not affect the lawfulness of processing before withdrawal.

If personal information is transferred outside the EEA or UK, we rely on applicable recognized transfer mechanisms where required, such as adequacy decisions or appropriate contractual safeguards.

You may complain to your local data protection authority. EEA authority information is available at:

European Data Protection Board

15. CHILDREN'S PRIVACY

Our Services are not directed to children, and we do not knowingly collect personal information from children under 13.

As of the date of this Privacy Policy, we do not have actual knowledge that we sell or share personal information of individuals under 16 years of age.

Where applicable law requires additional protections or consent for minors, those requirements apply.

If you believe a child has provided personal information to us inappropriately, contact us so we can investigate and take appropriate action.

16. CHANGES TO THIS POLICY

We may update this policy to reflect changes in our practices, Services, or legal requirements.

We will post the revised policy, update its last-updated date, and provide additional notice or obtain consent where required by law.
